This page contains product-specific terms ("Product Addenda") that supplement our Terms of Service for individual products offered by X Enterprises, LLC ("X Enterprises," "we," "us," or "our"). Each Product Addendum applies only to the product it names, is incorporated into the Terms of Service for that product, and — in the event of a conflict — controls over the Terms of Service for that product.
If a product you use is not listed below, your use of that product is governed by the Terms of Service alone, together with the policies incorporated into it.
The following Product Addenda are currently in effect. When additional product-specific terms are adopted, they will be posted on this page with the date they take effect.
Effective: August 1, 2026
This Addendum applies to any Product that enables you to send email, SMS/text, or other messages to your own subscribers, customers, or other recipients ("Messaging Features," and each recipient, a "Recipient") — including, without limitation, our email marketing and newsletter products. It supplements the Terms of Service; capitalized terms not defined here have the meanings given there.
You, not X Enterprises, are the "sender" and "initiator" of every message sent through the Messaging Features, and you are solely responsible for the content of your messages, your Recipient lists, and your compliance with all laws applicable to your messaging — including the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), Canada's Anti-Spam Legislation (CASL) where applicable, and applicable carrier and industry requirements (including CTIA guidelines and campaign registration requirements such as 10DLC for SMS).
You represent and warrant that, for every Recipient:
Transactional and relationship messages (receipts, password resets, service notifications) are subject to the accuracy and identification requirements above, though consent rules for marketing messages may not apply to them.
We may monitor aggregate deliverability signals (bounce rates, complaint rates, spam-trap hits, carrier filtering) and may throttle, suspend, or terminate your use of Messaging Features — with or without notice — if your sending endangers our sending reputation, violates this Addendum or the Acceptable Use Policy, or triggers carrier or mailbox-provider enforcement. We may also require you to re-confirm consent for some or all of your list before resuming sending.
Your Recipient lists and message content are Your Data under the Terms of Service, and where they contain personal data we process on your behalf, the Data Processing Agreement applies. You are the controller of Recipient personal data; we are your processor.
In addition to the indemnification in the Terms of Service, you will indemnify, defend, and hold harmless X Enterprises from and against any claims, damages, penalties, fines, and expenses (including reasonable attorneys' fees) arising out of or relating to your messages, your Recipient lists, or your violation of this Addendum — including any claim under the TCPA, CAN-SPAM, CASL, or similar law.

This Addendum applies to any Product that provides an application programming interface, API keys, webhooks, or similar programmatic access ("API"). It supplements the Terms of Service; capitalized terms not defined here have the meanings given there.
API keys are credentials for your account. You are responsible for keeping them confidential, for all activity under them, and for rotating them promptly if you suspect compromise. Do not embed keys in client-side code, public repositories, or other locations accessible to third parties.
Your API use is subject to the rate limits, quotas, and usage caps published in the applicable Product's documentation or plan description, and to the Acceptable Use Policy. We may throttle or reject requests that exceed limits or that degrade service for others. You will not circumvent limits (including by using multiple accounts or keys for that purpose).
You will not use the API to: replicate or substantially recreate the Product; build a competing product or service; cache or store data beyond what your integration reasonably requires or the documentation permits; or misrepresent your application's identity or origin when making requests. Data obtained through the API remains subject to the Terms of Service and, where applicable, the Data Processing Agreement.
We may modify the API over time. For changes that break documented functionality in a paid Product, we will use reasonable efforts to provide at least 90 days' notice before retiring the affected version, except where a change is required for security or legal reasons. Beta or preview API endpoints may change or be withdrawn at any time.
API availability is covered by the Service Level Agreement only where the applicable Product and plan include SLA coverage; otherwise the API is provided "as is" without availability commitments.
We may suspend or revoke API access (in addition to our rights under the Terms of Service) where your usage poses a security, stability, or legal risk, or violates this Addendum. We will restore access when the issue is resolved where practicable.
We may adopt a new Product Addendum, or update an existing one, by posting it on this page. For material changes to an addendum that reduce your rights under a paid subscription, we will provide advance notice as described in the "Changes to these Terms" section of the Terms of Service.
